In short
This summary is for convenience. The numbered sections below are the terms.
- Placing an order is an offer to buy. The receipt email confirms we received your order and payment; your order is accepted when we confirm the ship date or ship it. If there is a pricing error or the item is unavailable, we can cancel and refund you in full.
- Prices are in US dollars. Freight on compressors and other truck-shipped equipment is included in the price within the contiguous United States. Other items in the same order can still add shipping: parts orders under $300, Slick Products orders under $150, Lucas Oil orders under $1,750 and pails, at the shipping amount shown with your totals. Free shipping on parts orders of $300 or more, Slick Products orders of $150 or more and Lucas Oil orders of $1,750 or more. Below those amounts, pails aside, the Lucas Oil items ship together for one flat $25 and the rest of the order for another. Pails have their own rates and never add a flat charge. Checkout shows your exact shipping and any delivery fee before you pay.
- Sales tax is calculated at checkout for every state where we are required to collect it.
- Unless we tell you otherwise, we expect to ship within 30 days of your paid order. If we cannot, we tell you and you can cancel for a full refund. If the delay runs more than 30 days past the date we gave you, we cancel and refund you unless you tell us to wait.
- Orders over $85,000 before tax are handled by invoice, paid by ACH or wire transfer.
- Inspect freight deliveries before you sign, and write any damage on the delivery receipt.
- The manufacturer's written warranty (Emax and others) is the only warranty on the products. We do not add a warranty of our own.
- If something goes wrong, our liability is limited to what you paid us for the order (Section 10). That limit does not apply to death or personal injury.
- The Compressor Desk is an automated AI assistant, not a person. It gives general guidance only and cannot commit us to anything. Confirm sizing with us before you buy.
- South Carolina law governs, and disputes go to the courts serving York County, South Carolina, unless your home state gives you the right to sue there. Call us first; most problems are solved with one phone call.
1. Who these terms cover
These terms apply to your use of piedmontind.com (the "Site") and to every order you place with Piedmont Industrial Sales LLC, a South Carolina limited liability company ("we", "us", "our") through the Site, by phone, or by accepting a quote or invoice from us. By using the Site or placing an order you agree to these terms and to our Returns and Refunds Policy, which is part of these terms. Our Privacy Policy explains how we handle your information.
If you are ordering for a business, you confirm you are authorized to bind that business.
2. Products
We sell air compressors and air treatment, pressure washers, hydro seeders, oils and lubricants, shop and lift equipment, and related parts and accessories from Emax and other manufacturers. Product descriptions, specifications, photos, and prices come from the manufacturer or from our catalog and are provided in good faith. We work to keep them accurate, but errors happen, and we may correct them at any time. Claims and guarantees in a manufacturer's product description are the manufacturer's. The manufacturer honors them, not us, and we will help you contact it.
3. Orders and acceptance
- Your order is an offer. Submitting an order through checkout, by phone, or by accepting a quote or invoice is an offer to buy at the stated price.
- Acceptance. After your payment goes through, we email you a receipt. The receipt confirms that we received your order and your payment; it is not our acceptance. We accept your order when we confirm the ship date with you or ship the product, whichever comes first. A payment receipt from PayPal is also not our acceptance.
- Our right to cancel. We may decline or cancel an order, in whole or in part, before it ships if the price was listed in error, the product is out of stock or discontinued, we cannot verify your payment or shipping details, the order is outside the area we serve online (Section 5), or we suspect fraud. If we cancel, we will tell you and refund any amount you paid, in full, to your original payment method.
- Orders handled by invoice. Online checkout accepts orders up to $85,000 before tax. Larger orders, and orders that need a freight quote (some pail orders; see Section 5), are handled by invoice: the checkout page takes your contact details instead of a card, and we send you an invoice. We may also limit quantities.
- Quotes. A written quote or invoice from us is valid until the expiration date printed on it, which is 30 days from its date unless we state otherwise. Quoted prices can change if the manufacturer changes its pricing before you accept.
4. Pricing, payment, and tax
- Prices are in US dollars and can change without notice, except that the price confirmed for an accepted order will not change. The total shown at checkout is calculated by our system from our current catalog, whatever an older page, cart, or saved link may have shown.
- Online payment is processed by PayPal: card, PayPal account, or any other option PayPal offers you at checkout. We never receive or store card numbers.
- Invoice payment. Orders handled by invoice are paid by ACH or wire transfer. Phone orders may be paid by card over the phone, by PayPal invoice, or by ACH or wire transfer. Payment is due in full before shipment unless your invoice says otherwise.
- Sales tax. Sales tax is calculated at checkout, on the merchandise, for every state where we are required to collect it. We do not charge sales tax on shipping or delivery charges. Where we do not collect tax on your order, you are responsible for any use tax your state requires. If you are tax-exempt, send us a valid exemption certificate before you order; we cannot refund tax after the fact except as the law allows.
- Promotions (for example free shipping or a free kit with a machine) apply only to the products and dates stated and cannot be combined unless we say so.
5. Shipping and delivery
What shipping costs. The checkout shows the exact shipping and delivery charges for your cart before you pay, and those are the charges that apply. The rules behind them are:
- Truck-shipped equipment. Compressors, hydro seeders, pressure washers and washer trailers, bulk totes, and any item over 150 pounds ship by freight truck. Freight is included in the price for delivery within the contiguous United States. Other items in the same order can still add shipping: parts orders under $300, Slick Products orders under $150, Lucas Oil orders under $1,750 and pails, at the shipping amount shown with your totals. Checkout asks what kind of address you are shipping to. A business with a loading dock or forklift pays nothing extra. A business without a dock needs a liftgate truck, and for that, or for a residential address, a delivery fee may apply; checkout shows any such fee before you pay.
- Everything else. Free shipping on parts orders of $300 or more, Slick Products orders of $150 or more and Lucas Oil orders of $1,750 or more. Each of those counts only its own items: Lucas Oil items toward the Lucas Oil amount, Slick Products items toward the Slick Products amount, and everything else, which we call parts, toward the parts amount. Below those amounts, pails aside, the Lucas Oil items ship together for one flat $25 and the rest of the order for another.
- Pails. Pails ship at $54.99 for one, $84.99 for two and $114.99 for three; four or more by freight quote. A pail never adds a flat charge. Larger pail orders are handled by invoice.
- Large orders. Orders of $1,750 or more ship free, pails included.
If you choose the wrong delivery type, the carrier may bill the difference, and we will pass that charge on to you.
Where we ship. Online checkout serves addresses in the contiguous United States. Orders to Alaska, Hawaii, US territories, or outside the United States are quoted directly; call us.
Who ships it. Many products ship directly from the manufacturer or distributor rather than from our location, so a single order can arrive in more than one shipment.
Timing. "Ship" means we hand your order to the carrier; freight transit time comes after that. Unless a product page, your quote, or our confirmation gives a different time, we expect to ship within 30 days of receiving your paid order. If we learn we cannot ship by the time we stated (or within 30 days, if we stated none), we will tell you before that date, give you a revised ship date if we know one, and let you cancel for a full refund at no cost to you. If the new date is more than 30 days after the original one, or we cannot give you a new date, we will cancel your order and refund you in full unless you tell us you want to wait. If you or we cancel an unshipped order, we refund you within 7 business days. Once your order has shipped, transit times are estimates, and we are not liable for delays caused by the carrier, weather, or other events outside our control.
Delivery appointment. For freight deliveries the carrier will usually call to schedule a delivery window. You or an authorized adult must be present. Missed appointments, redelivery, storage, and address changes after shipment are billed at the carrier's rate and are your responsibility.
Unloading. Unless your delivery includes a liftgate, freight is delivered to your dock or curbside and unloading is your responsibility. Most compressors need a forklift or similar equipment.
Inspect before you sign. Count the pieces and inspect the packaging and equipment for damage BEFORE signing the delivery receipt or bill of lading (BOL). Write any shortage or damage, even minor, on the BOL before signing, and take photos. If the damage is severe, you may refuse the delivery and note the reason on the BOL. A clean signature is the carrier's evidence that the goods arrived in good condition and can make a damage claim impossible to recover. Report damage to us within 48 hours of delivery, including damage you find after signing, as our Returns and Refunds Policy explains.
6. Title and risk of loss
Title to and risk of loss for the products pass to you when the carrier delivers them to the shipping address you provided. We will help you with a carrier damage claim when you have noted the damage on the BOL as described above.
7. Warranties and disclaimers
- Manufacturer warranty. Products are covered by the manufacturer's written warranty (for example, the Emax warranty that ships with the unit), which is the only warranty that applies. Warranty terms, registration requirements, covered parts, and exclusions are set by the manufacturer. We will help you start a warranty claim, but the manufacturer decides it. Before you buy, you can ask us for a free copy of the manufacturer's written warranty for any product: call or email us and we will send it.
- Proper use. Warranties generally require installation, electrical supply, maintenance, and use in line with the manufacturer's manual. Improper installation, wrong voltage or phase, lack of maintenance, or misuse can void the manufacturer's warranty and is not our responsibility.
No warranty of our own. The manufacturer's written warranty is the only warranty on the products we sell. TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND WE GIVE NO WARRANTY AGAINST INFRINGEMENT. This does not limit the manufacturer's warranty. Some states do not allow these exclusions, so they may not apply to you.
8. Installation and sizing
- Installation is your responsibility unless we have quoted installation and you have accepted it as a separate line item. Installation must be done by a qualified professional, and electrical work by a licensed electrician in line with local code.
- Sizing. Choosing the right compressor, horsepower, tank size, voltage, phase, and air treatment for your application is your responsibility. We are glad to help by phone, and we recommend confirming the fit with us before you buy. Information on the Site, including the Compressor Desk, is general guidance and not a guarantee that a product suits your application.
9. The Compressor Desk online assistant
The Compressor Desk is an automated AI assistant, not a person. It answers questions about the products in our catalog, says it is an AI assistant in the chat window for the whole conversation, and will tell you so if you ask. It is provided for convenience and general guidance only:
- Its answers are generated automatically and can be incomplete or wrong.
- It is not engineering, electrical, building-code, legal, financial, or medical advice. Have a qualified professional check anything that matters for safety or code compliance.
- Any sizing recommendation from the assistant must be confirmed with a person at our shop before you buy. Call 803-981-3651.
- The assistant cannot commit us to a price, ship or delivery date, warranty term, or service. Only a written quote, invoice, or our acceptance of your order does that. Fleet, export, and multi-unit pricing is always quoted by a person.
- The assistant may limit how long a conversation runs and will point you to the shop when it reaches that limit.
- Do not enter payment card information or other sensitive personal information into the assistant.
- You keep whatever rights you have in what you type. You allow us and our service providers to use your messages only to answer you, to handle and keep a record of a callback you ask for, and to keep the Site working and secure. We do not use them to train AI models. Our Privacy Policy explains what is kept and for how long.
We are not liable for decisions made in reliance on the assistant's output without confirmation from our staff.
10. Limitation of liability
Our liability is limited. To the fullest extent allowed by law:
- We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost production, downtime, lost data, or the cost of substitute equipment, arising from the products, the Site, or these terms, even if we were told they were possible.
- Our total liability for any claim related to a product or order will not exceed the amount you paid us for that product or order.
- These limits apply to all claims, whether in contract, warranty, tort (including negligence), or otherwise, and do not limit any liability that cannot be limited by law.
- These limits do not apply to death or personal injury caused by a product or by our negligence, to fraud, or to our willful misconduct.
- These limits also protect the companies that build and run the Site and the Compressor Desk for us, including Robinson Labs LLC, and they may rely on them.
11. Acceptable use of the Site
You agree not to: use the Site for any unlawful purpose; try to access accounts, systems, or data you are not authorized to access; scrape, crawl, or bulk-download the Site or catalog except as a search engine normally does; interfere with the Site's operation or security; try to make the Compressor Desk ignore its instructions, reveal its configuration, or produce content unrelated to our products (sometimes called prompt injection); use automated tools to flood the Compressor Desk, checkout, or forms; submit false orders, invoice requests, or contact information; or use the Site to send spam. We may block, rate-limit, or ban anyone who violates these rules.
12. Intellectual property
The Site, its design, text, photos, catalog data, logos, and the Compressor Desk are owned by or licensed to Piedmont Industrial Sales and are protected by copyright and trademark law. Manufacturer names, logos, and product images belong to their owners and are used to identify their products. You may view and print pages for your own purchasing use. Any other use needs our written permission. If you believe something on the Site uses your work or mark without permission, email shane@piedmontind.com and we will review it and remove it promptly if needed.
13. Third-party services and links
Payment is processed by PayPal under PayPal's own user agreement and privacy statement. The Site links to manufacturer websites and other third parties that we do not control and are not responsible for.
14. Privacy
Our Privacy Policy explains what information we collect and how we use it.
15. Governing law and venue
These terms and any order are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. Unless the law of the state where you live gives you the right to bring a claim there, any lawsuit related to these terms, the Site, or an order will be brought only in the state or federal courts located in or serving York County, South Carolina, and you consent to their jurisdiction. Nothing here prevents either of us from bringing a claim in small claims court where permitted.
16. Talk to us first
If you have a problem with an order, please call us at 803-981-3651 or email shane@piedmontind.com first and give us 30 days to make it right. Most issues (shipping damage, a missing part, a warranty question) are fixed with one phone call. This does not limit any right you have with PayPal or your card issuer.
17. General
- If any part of these terms is found unenforceable, the rest still applies.
- Our failure to enforce a term is not a waiver of it.
- These terms, your receipt or order confirmation, any written quote or invoice, our Privacy Policy, and our Returns and Refunds Policy are the entire agreement between us for your order. Terms on your purchase order or other forms do not apply unless we sign them.
- You may not assign your order or these terms without our consent.
- We are not responsible for failures caused by events outside our reasonable control.
18. Changes to these terms
We may update these terms from time to time. The version posted on the Site when you place your order is the version that applies to that order.
